Please read this Telehealth Policy carefully as they form a legally binding agreement between you, the user, and CarePage, Inc., along with our corporate affiliates, collectively known as "CarePage", "We", "Our" or "Us".

This Telehealth Policy governs all telehealth related access to and use of any telehealth services we offer across all modalities, referred to collectively as the "Services"; these modalities include but are not limited to: secure messaging, video conferencing, telephone, email, and sms mobile text-based messaging; and any other modality operated by CarePage that are linked to telehealth services.

By using any of our Services, clicking "Agree & Continue" or simply by accessing or using the Services, you confirm that you have read, understood, and consent to be bound by this Telehealth Policy, along with our Terms of Service and Privacy Policy.

Introduction

This Telehealth Services Policy governs the use of telehealth-related services ("Telehealth Services" provided by CarePage, Inc. ("CarePage", "we", "us", "our"). These services are designed to enable users ("you") to connect with healthcare providers for the provision of medical services remotely. This policy is to be read in conjunction with our Terms of Service, and in the event of any conflict, the provisions of this Telehealth Services Policy shall prevail.


We continuously develop our Services and reserve the right to modify this Telehealth Policy at any point at our sole discretion. When changes are made, we will notify you by email, through the Services, or by updating the "Last Updated" date at the start of this Telehealth Policy. Regularly reviewing this Telehealth Policy and our other policies is advised to ensure you remain informed of any changes, which will take effect once posted. If you do not agree with the Telehealth Policy at any time, your exclusive remedy is to discontinue using the Services. Continued use after changes have been posted means you accept those changes. If you do not agree to the revised Telehealth Policy, you should not access or use the Services. All Services are provided "as is" and "as available" without any warranties of any kind. CarePage disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. CarePage does not guarantee that the Services will be error-free or uninterrupted, or that defects will be corrected.

Consent to Telehealth Services

By using our Telehealth Services, you provide informed consent to receiving healthcare services via remote or telecommunication technologies. You also acknowledge that you understand the potential risks and benefits associated with telehealth and have had the opportunity to have any questions answered. Usage of our Telehealth Services is voluntary and you may withdraw your consent at any time.

Privacy and Security in Telehealth

We are dedicated to maintaining the confidentiality and integrity of your personal health information. Our Telehealth Services are compliant with applicable health privacy laws, including HIPAA, and we employ robust security measures to protect your data.

Provider Qualifications

All healthcare providers ("Providers") offering services through our Telehealth Services are licensed healthcare professionals, credentialed according to state and federal requirements. Providers are independent contractors and are not employees of CarePage.

Access and Use of Telehealth Services

To access our Telehealth Services, you may be required to meet certain technological requirements. These include, but are not limited to, a stable internet connection, a computer or device with a camera, microphone, and speakers/headphones, and the latest version of a compatible web browser. You are responsible for ensuring your equipment and internet connection are compatible with our specifications. A majority of CarePage Telehealth Services can and will be provided using secure messaging based communications.

Before any virtual conferencing appointments, if and when applicable, please ensure your device is fully charged or plugged in, test your internet connection, and verify that your camera and microphone are working properly. Additionally, find a private, well-lit, and quiet space to conduct your telehealth visit to maintain privacy and ensure clear communication with your healthcare provider. It is your responsibility to ensure that your equipment and internet connection are compatible with our specifications.

Limitations of Telehealth

Telehealth is not a replacement for in-person healthcare in all cases. Some conditions may require direct, physical examination or emergency treatment, which are beyond the scope of our Telehealth Services. If you are experiencing a medical emergency, immediately contact your healthcare provider or dial 911.

Emergency Protocols

In the case of an emergency arising during a telehealth consultation, Providers will follow an established protocol to ensure your safety, which may include asking you to call 911 or directing you to urgent or emergency care facilities. Providers may not be available to follow up with you after an emergency and are not responsible for any outcomes resulting from your failure to seek immediate medical attention.

Record Retention

We will maintain records of your telehealth interactions as required by law. These records will be retained securely and will be accessible to you in accordance with our Privacy Policy.

User Responsibilities

You are responsible for providing accurate and complete information about your health history and current condition. You also agree to follow through with the treatment plan as prescribed by your Provider.

Payment and Fees

You are responsible for all fees associated with your use of the Telehealth Services. These fees will be disclosed to you prior to your appointment. You may be required to provide a valid credit card or other payment method to use the Services. By providing this information, you authorize us to charge your credit card or other payment method for the fees associated with your use of the Services. You are responsible for maintaining complete and accurate billing and contact information in your account. If your payment method fails, you will be responsible for any uncollected amounts and we may suspend or terminate your access to the Services. CarePage does not offer prescription services and does not dispense or directly sell medications of any kind. CarePage does not accept insurance of any kind.

Eligibility and Responsibilities

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years old. You also represent and warrant that you (a) have not previously been suspended or removed from the Services; (b) do not have more than one CarePage account at any given time; and (c) that you have full power and authority to enter into this agreement and in doing so will not violate any other agreement to which you are a party. To use our Telehealth Services, users must meet eligibility criteria including age restrictions and geographic location, as permitted by law. Users are responsible for ensuring that the information they provide is accurate and complete and for following the healthcare provider’s instructions during the course of treatment.

Service Availability

Our Telehealth Services are available during specific hours, which can be found on our scheduling page. Availability may be subject to change based on provider availability or system maintenance.

Prescriptions and Treatment Plans

Providers may issue prescriptions as part of telehealth consultations if deemed appropriate and in accordance with state and federal regulations. Treatment plans will be communicated clearly to you and will be available for review in your user account. You are responsible for following the advice and guidance of your Provider. You are responsible for any fees related to medications or prescriptions.

Feedback and Quality Assurance

We welcome feedback on our Telehealth Services as part of our commitment to quality assurance. Users can submit feedback through the contact methods provided on our platform.

Indemnification Agreement

You agree to indemnify, defend, and hold harmless CarePage and its affiliates, officers, directors, employees, and agents from any third-party claims, actions, demands, damages, or costs, including reasonable legal fees, arising from or related to your improper use of the Services, any fraudulent activities, violations of law, willful misconduct, or breaches of this Telehealth Policy or our Terms of Service.
